Perhaps even more challenging is ensuring your processes for collection are fully defensible in court. How do you balance your duty to uncover and produce responsive information with the cost of discovery and inevitable disruption to your business? How much data is enough? Where do you find it all? Evidence Collection Services
Your staff may have the technical skills required to collect data, but do they possess the resources, tools, or procedures to manage evidence collection in a manner that is defensible for the legal process? Improper collection can lead to:
- Increased litigation costs
- Issues with downstream processing and production
- Increased risk that electronic evidence may be disallowed in court
- IT personnel having to take the stand to defend their collection methods
Fios helps you understand the types of data that should be collected for your particular matter, as well as the size and location of the potentially responsive data. As a result, you can make informed decisions when preparing for litigation. We also ensure that all collection methods are defensible in court and integrate seamlessly into downstream evidence processing systems.

Is Lost Data Truly Lost?
In many cases, deleted data is not really gone from a computer or storage device. Only the visible link to the file is gone.
Even if a file is deliberately overwritten, many fragments can still be retrieved. You simply need a forensics collection expert to find it.
If you require forensics collections, Fios will travel to the agreed upon location and create a duplicate image (i.e., physical bit-stream) of all targeted hard drives. These images will include ambient data-swap file, unallocated space and file slack.
We will also work with you to retrieve and restore archival data from back-up tapes and other archival storage devices.
