Authenticating Evidence for E-Discovery

Authenticating evidence in civil trials is coming into its own. Traditionally, this level of authentication has been primarily argued in criminal cases. Last May, Magistrate Judge Grimm, in Lorraine v. Markel Am. Ins. Co., set down persuasive parameters for authenticating evidence that every practitioner needs to understand. Lorraine, getting more traction by the day, goes beyond the "breathalyzer" standard of In re Vinhnee. This webcast will present a discussion around:
- The importance of authenticating evidence from the point of collection through production (chain of custody, metadata, spoliation, etc.)
- How to avoid exposing your company or client to spoliation by making sure dates stay stable (or how to explain why they didn't)
- How evolving technologies, such as e-mail archiving and enterprise content management (ECM) systems, can help enable the process and how to address their authentication challenges.
